Environmental Assessments and Authorizations: SEA - EIA - IPPC Permit

The European Commission has closed two infringement procedures against Italy regarding the Environmental Impact Assessment: the infringement procedure 2009/2086, initiated mainly for the non conformity of national legislation (Part Two of the Law 152/2006) to the EIA Directive 2011/92 / EU in relation to EIA screening procedure, and the procedure 2013/2170 initiated for the incorrect transposition of the flood-relief works project category.

In order to overcome the main issue of the infringement procedure 2009/2086, the " Guidelines for the EIA screening of projects falling within the competence of the Regions and Autonomous Provinces  (Annex IV to Legislative Decree 152/2006)" were issued with the ministerial decree No. 52 of 30 March 2015, drawn up on the basis of all the criteria of Annex III to the EIA Directive and not only on the basis of dimensional and location criteria.
